Terms of Service

Welcome to Canadian Outdoor Journal. These Terms of Service ("Terms") govern your access to and use of our website located at CanadianOutdoorJournal.com (the "Site"), our digital products, subscription services, and any related content or services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part, you may not access the Services. These Terms apply to all visitors, users, and others.

Important: These Terms contain a mandatory arbitration provision and class action waiver. It affects your rights regarding how disputes are resolved. Please read Section 14 carefully.

1. Our Services

Canadian Outdoor Journal provides a platform for outdoor enthusiasts. Our Services include, but are not limited to:

  • Digital trail guides and maps for purchase.
  • A community-driven trail review and submission system.
  • Affiliate gear review program and related content.
  • Subscription-based access to premium guides and seasonal content.
  • Educational articles on outdoor lifestyle, nature exploration, and travel across Canada.

We reserve the right to modify, suspend, or discontinue any Service at any time. We are not liable for any modification or discontinuance.

2. Account Registration

You may need to register an account. You must provide accurate information and keep it updated. You are responsible for all activities under your account and must maintain password confidentiality.

You must be at least 16 years old to use our Services. If you are under 16, you may only use the Services with parental consent.

3. Purchases & Digital Products

3.1. Payment

All purchases are processed through secure third-party payment processors. Prices are in Canadian Dollars (CAD) and include applicable GST/HST. You authorize us to charge the chosen payment method.

3.2. Digital Guide License

When you purchase a digital guide, you receive a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use. You may not redistribute, resell, or modify the content.

3.3. Refunds

Due to the digital nature of our core products, refunds are generally not provided after download or access is granted. Please review our separate Refund & Cancellation Policy for specific circumstances.

4. User-Generated Content

You retain ownership of any content you submit ("User Content"), such as trail reviews or photos. By submitting, you grant us a worldwide, royalty-free license to use, display, and distribute that content in connection with our Services.

You agree your User Content will not:

  • Violate any third-party rights (copyright, privacy, etc.).
  • Be unlawful, threatening, or misleading.
  • Contain unsafe or inaccurate trail conditions that could cause harm.

We may remove any User Content at our discretion.

5. Intellectual Property

All content on the Site (except User Content), including text, graphics, logos, software, and digital guides, is owned by Canadian Outdoor Journal or its licensors and is protected by Canadian and international copyright laws.

The "Canadian Outdoor Journal" name, logo, and related marks are our trademarks. You may not use them without prior written permission.

6. Affiliate Gear Program

Participants in our gear affiliate program agree to provide honest, unbiased reviews. You must disclose any material connection to a brand if one exists. We may share commission from qualifying purchases made through your affiliate links.

Program specifics are governed by a separate affiliate agreement.

7. Subscription Services

Subscriptions automatically renew until cancelled. You can cancel anytime via your account settings. No refunds for partial subscription periods.

8. Prohibited Activities

You agree not to:

  • Use the Services for any illegal purpose.
  • Attempt to gain unauthorized access to any part of the Services.
  • Use data mining or similar data gathering tools.
  • Interfere with the security or functionality of the Services.
  • Impersonate any person or entity.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available." We disclaim all warranties, express or implied. We do not warrant that the Services will be uninterrupted, secure, or error-free.

Outdoor Activity Risk: Our digital guides and content are for informational purposes only. Outdoor activities carry inherent risks. You are solely responsible for your safety, preparedness, and for checking current trail conditions and regulations.

10. Limitation of Liability

To the maximum extent permitted by Canadian law, Canadian Outdoor Journal shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.

Our total liability for any claim shall not exceed the amount you paid to us in the last 12 months.

11. Indemnification

You agree to indemnify and hold harmless Canadian Outdoor Journal from any claim arising from your breach of these Terms, your User Content, or your violation of any law.

12. Termination

We may suspend or terminate your account and access to Services at our sole discretion, without notice, for conduct we believe violates these Terms or is harmful to others.

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia.

14. Dispute Resolution & Arbitration

Mandatory Arbitration: Any dispute arising from these Terms shall be resolved by final and binding arbitration in Vancouver, BC, under the British Columbia International Commercial Arbitration Centre rules.

Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Privacy & Data

Your privacy is important. Our collection and use of personal information is governed by our Privacy Policy. The data controller is:
